Botox Regulation Up for Debate

Legislators in Texas and New Jersey are considering tighter regulation on Botox and other injectable treatments.

Botox is an injectable product made from botulinum toxin that can temporarily erase facial wrinkles without the need for a facelift. Although Botox is a controlled substance, this merely means that only someone with a medical license can order the product, and there are almost no limitations on who can administer the shots.

The Texas Medical Board recently considered making changes to the rules about who can perform cosmetic procedures that use prescription medications, which would include Botox and injectable fillers such as Juvederm, Radiesse, and Sculptra. While action on the initiative seems unlikely, it reflects a growing trend toward greater Botox regulation and quality control.

Botox regulation has also become a hot topic in New Jersey, where legislators have introduced a bill that would ban Botox for teens. Bill A3838, introduced by Assemblywoman Cleopatra Tucker, would make it illegal for minors to access Botox treatments without a doctor’s note confirming that the procedure is medically necessary. (Botox has medical uses that include the treatment of certain migraines and cerebral palsy symptoms.)

Botox regulation is supported by many who fear that unscrupulous providers are taking advantage of the rising popularity of the treatment. To achieve the best results, Botox procedures should be performed by licensed, recognized practitioners who have training to perform aesthetic procedures. Those who save a few dollars by going to someone with little experience or training are making poor decisions.
